Terms of Service

1. Acceptance of Terms

By creating an account or using the Cart4Cause website or mobile applications ("Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our Platform.

2. What Cart4Cause Does

Cart4Cause is an affiliate fundraising platform. When you shop at a participating online store through our Platform, we earn an affiliate commission. 50% of that commission is donated to the NGO or cause you have selected. We do not mark up prices — you pay the same price you would pay directly on the merchant's website.

3. Eligibility

• You must be at least 13 years old to use Cart4Cause
• You must reside in India or be shopping from India
• NGO accounts require a valid Darpan registration and bank account in India

4. Commissions & Donations

• Commissions are earned only when a qualifying purchase is completed and confirmed by the affiliate network (Cuelinks)
• Commissions can be cancelled if the order is returned or the transaction is flagged as fraudulent
• The 50% donation share is calculated after the affiliate network's fees are deducted
• Donations are transferred to the NGO's registered bank account on a regular payout cycle, subject to minimum payout thresholds
• Cart4Cause is not responsible for delays caused by the affiliate network or banking systems

5. Retailer Relationships & Tracking Limitations

5.1 Independent Transactions: When you purchase goods or services from a retailer through Cart4Cause, that transaction is a separate contract between you and the retailer. Cart4Cause is not a party to that contract and has no responsibility or liability for:

• Product quality, delivery, returns, or customer service
• Retailer pricing, promotions, or availability
• Disputes between you and the retailer
• Any loss or damage arising from your use of retailer services

5.2 No Warranty on Retailers: Cart4Cause makes no warranty or representation regarding the veracity, conduct, or performance of any retailer. We are not responsible if a retailer:

• Does not report your purchase to our affiliate network
• Does not pay commission to Cart4Cause
• Changes commission rates or terms without notice
• Becomes insolvent or ceases trading

5.3 Tracking Limitations: We use cookies and affiliate tracking technology (via Cuelinks) to record purchases. Tracking may fail if:

• You do not proceed directly from Cart4Cause to the retailer's website
• You use ad blockers, privacy extensions, or other cashback browser extensions
• The retailer has policies that prevent tracking when multiple affiliate cookies are present
• You clear cookies before completing your purchase
• Technical issues occur with cookies or tracking systems

5.4 No Liability for Tracking Failures: Cart4Cause is not liable for any failure of tracking technology to record transactions or for any consequential failure to generate donations. We make reasonable efforts to track purchases but cannot guarantee all transactions will be recorded.

5.5 Commission Payment: Donations are funded from commission we receive from retailers. If a retailer does not pay commission, we cannot generate a donation. We use reasonable endeavors to recover unpaid commission but are not liable if we cannot.

6. Account Security & Single Account Policy

You agree that:

• You will register only one account per person
• Your account is for your sole use and may not be shared
• You are responsible for maintaining the confidentiality of your password
• You will notify us immediately if you suspect unauthorized access to your account
• Cart4Cause may disable any account if we reasonably believe it has been compromised or shared

Cart4Cause has no liability for any loss or damage arising from your failure to protect your account credentials.

7. Referral Programme

• You may share your unique referral link to invite others to Cart4Cause
• Referral codes must not be posted on public coupon or cashback websites
• Any attempt to artificially inflate referral counts or commissions will result in account termination

8. NGO Responsibilities

NGOs that register on Cart4Cause agree to:

• Provide accurate and verifiable registration information (Darpan ID, PAN, bank details)
• Use received funds solely for charitable purposes as described in their registration
• Notify Cart4Cause promptly of any changes to their registration details
• Not misrepresent their activities, impact, or legal status

Cart4Cause reserves the right to suspend or remove any NGO that violates these responsibilities or fails to maintain their approved status.

9. Prohibited Conduct

You may not:

• Use the Platform to commit fraud or generate fake transactions
• Attempt to reverse-engineer, hack, or abuse our API
• Create multiple accounts to abuse referral or donation programmes
• Impersonate another user, NGO, or Cart4Cause staff
• Use automated bots or scrapers on our Platform

Violation of any of the above will result in immediate account suspension and may be reported to the appropriate authorities.

10. Disclaimer of Warranties

The Platform is provided "as is" without warranty of any kind. We do not guarantee that:

• Every store click will result in a trackable commission
• The Platform will be available without interruption
• Commission rates from merchants will remain constant

11. Limitation of Liability

To the maximum extent permitted by law, Cart4Cause will not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform, including but not limited to lost donations, missed commissions, or data loss.

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform after any changes constitutes acceptance of the new Terms.
